1. ABOUT KODMART

Kodmart is a business-to-business product compliance information service operated by Limoservices s.r.o. ("Kodmart", "we", "us" or "our").

Kodmart provides structured product compliance screening intended to help businesses identify potentially applicable European Union regulatory requirements, information gaps and areas that may require further review.

These Terms of Service govern your access to and use of the Kodmart website and services.

By using the website or submitting a product for screening, you agree to these Terms of Service.

2. BUSINESS USERS

Kodmart is designed primarily for businesses, professionals and organisations.

By submitting information to Kodmart on behalf of a company or organisation, you confirm that you are authorised to do so.

3. NATURE OF THE SERVICE

Kodmart analyses information supplied by the user against structured compliance information and screening criteria.

Kodmart does not provide legal advice.

Kodmart is not a certification body, notified body, testing laboratory, market surveillance authority or authorised conformity assessment body unless explicitly stated otherwise.

A Kodmart screening result does not constitute:

• legal advice;

• certification;

• product approval;

• regulatory approval;

• a declaration of conformity;

• proof of compliance;

• a guarantee that a product complies with applicable law; or

• an official conformity assessment.

Where legislation requires testing, certification, conformity assessment, technical evaluation or involvement of an authorised or notified body, the user remains responsible for obtaining the appropriate professional service.

5. SCREENING RESULTS

Screening results are based on the information available to Kodmart and the information submitted by the user at the time of the screening.

Product regulation can depend on factors including product design, intended use, technical characteristics, components, target market, user group and other circumstances.

Accordingly, a screening result should be treated as an informational starting point for further compliance review and not as a final determination of legal or regulatory compliance.

6. USER-PROVIDED INFORMATION

The quality and relevance of a screening result depend on the accuracy and completeness of the information submitted.

You are responsible for ensuring that information and documentation supplied to Kodmart are accurate, complete and not misleading.

Kodmart is not responsible for incorrect, incomplete or misleading results caused by incorrect, incomplete, outdated or misleading information supplied by the user.

If material product information changes, a previous screening result may no longer be applicable.

7. REGULATORY INFORMATION

We aim to maintain useful and structured regulatory information. However, laws, regulations, standards, guidance and regulatory interpretations may change.

We do not guarantee that every potentially applicable requirement will be identified in every screening or that information available through the service will at all times be complete, current or error-free.

8. AUTOMATED PROCESSING

Parts of the Kodmart service may use automated rules, software systems or other automated processing methods to analyse submitted information and generate screening results.

The existence of a Kodmart screening result does not remove the user's responsibility to evaluate the product and applicable regulatory obligations.

9. CUSTOMER RESPONSIBILITY

The manufacturer, importer, distributor, economic operator or other responsible business remains responsible for determining and fulfilling its legal and regulatory obligations.

Kodmart does not assume the regulatory responsibilities of the user or any economic operator.

Users remain responsible for deciding whether additional testing, documentation, professional advice, certification or conformity assessment is required before a product is manufactured, imported, distributed, advertised, offered for sale or placed on the market.

10. ORDERS AND PAYMENT

Where a Kodmart service is offered for a fee, applicable pricing and payment information will be displayed before purchase or otherwise agreed with the customer.

We reserve the right to change prices or service packages for future orders.

Payment of a fee does not guarantee that a particular product will satisfy regulatory requirements.

11. REFUNDS

Eligibility for refunds is governed by the Refund Policy displayed on the Kodmart website and any mandatory rights that cannot legally be excluded.

Because screening may involve processing customer-specific product information, different refund conditions may apply once processing of a requested service has begun or been completed.

12. INTELLECTUAL PROPERTY

The Kodmart website, screening methodology, structure, original text, branding, software elements and other original materials provided through the service may be protected by intellectual property rights.

Except where permitted by law or expressly authorised by us, users may not copy, reproduce, distribute, resell or commercially exploit Kodmart materials or screening systems.

The user retains ownership of product information and documentation submitted to Kodmart, subject to the rights necessary for us to process that information and provide the requested service.

You must not use Kodmart:

15. AVAILABILITY OF THE SERVICE
